- Respond to two classmates posts: Fatima- I think that if Democrats win the senate on Nov 3rd, I wouldn’t want them to pack that court. I believe that 9 justices is a pretty good number, it isn’t too many or too little, there is enough to be able to create a pretty good debate on topics. I would however, like to pursue term limits for supreme court justices. I have no doubt that they are all capable of fulfilling their role in the supreme court regardless of their age, but you cannot deny that the older someone is, they loose some capacity. Instead, if there were new judges every so often, there would be new ideas flowing in, the two parties wouldn’t necessarily be fighting about which one gets to control because, like presidential elections, they can always try to win in the next term. Nonetheless, the only way to be able to set limits on supreme court justices, as mentioned in the article, would be if 3/4 of the states were to agree with it since it is the Constitution that needs to be changed. That is the part where I think that idea would die because I don’t think 38 states would agree to that, mostly Republican/conservative states in my opinion since they typically don’t want to sway away from the norm. In regards to Kavanaugh and Amy Coney Barrett, I think that they should be investigated because their process in becoming supreme court justices seemed rushed to me, I don’t think that everything was done like it has been done with other judges (currently thinking of is Biden’s nominee Ketanji Brown Jackson). If something is found to be rushed or not done legally, then they should definitely be impeached.

The rules regulating the United States Supreme Court need to be changed to reflect the realities of current life in the United States. Since the federal court was established in the 1700s, the average term of a Supreme Court judge has increased dramatically, granting outsized authority to nine people in ways the Constitution’s authors could never have envisaged. The lack of regularity in openings as a consequence of this longevity has added to the unpredictability of the judicial selection process. As a consequence, the confirmation process for the Supreme Court has become polarizing, with razor-thin margins of victory and theatrics from the candidates. This situation is unsustainable, and lawmakers must move to change it by introducing legislation that establishes term limits for judges. Regular appointments, on the other hand, should make confirmation less politicized. There would be less pressure on each individual selection, for example, since it would be understood that winning the president entails the nomination of two justices. Furthermore, establishing a more regular selection procedure would guarantee that the court is more representative of the general people. Presidents may get a larger or smaller number of appointments as a consequence of chance, resulting in a court that is out of sync with society as a whole. Justices’ lifetime appointments are resulting in ever longer terms, with substantial ramifications for the court’s politicization. Term limitations for justices would assist to ensure consistency in vacancies and prevent an escalation of the negative consequences associated with justices’ ever-longer lifetime tenures. The Supreme Court’s nine members have enormous authority over the lives of Americans. As a result, it’s critical that the composition of that court be decided by Americans’ support for those in charge of choosing and confirming federal judges, rather than by chance
